Abstract

The classification (tasnif) of maqasid al-shariah is often
repeated as classical theory without being tested as a working
tool in contemporary ijtihad. This study maps classical and
contemporary classifications of maqasid, formulates a five
step test for contemporary ijtihad, and applies it to two cases:
the decision of the 7th Ijtima’ of the Indonesian Fatwa
Commission (2021) on cryptocurrency and Indonesian
Ulema Council (MUI) Fatwa No. 86 of 2023 on climate
change control. It is a qualitative library study using content
analysis and a classification matrix. The classical three-level
scheme over the five essentials needs to be complemented by
classification by scope (general, specific, partial) and by
subject (individual, society, humanity). The crypto decision
does not formulate maqasid explicitly; its prohibition as
currency can be read as protecting wealth on the preventive
side, while the conditional permission fits a hajiyyat need.
The climate fatwa works on both the preventive and the
realisation side but mentions the essentials only generally.
The study concludes that classification makes maqasid
reasoning traceable, provided that textual control and the
qualifications of the mujtahid are retained. The findings are
